Why does the client need to appoint their own expert if the Insurance Company has already appointed one?
The Insurance Contract Law recognizes the right of each party involved in an insurance contract—Policyholder and Insurance Company—to appoint an Expert to ensure the fairness of the appraisal process.
The need to appoint your own Expert arises from the inherently subjective nature of an appraisal. As a general rule, two Experts only reach an agreement after the appraisal process.
If one party is absent or not properly empowered, this balance can be disrupted, typically to the detriment of the weaker party—the Policyholder.
What are the advantages for a Policyholder in hiring their own independent appraisal?
The objectives of any independent appraisal are fundamentally three:
- The client receives the compensation they are entitled to, optimizing the insurance policy they have contracted.
- The client receives the compensation within the timeframes established by law.
- The client can fully focus on their business, knowing that the claim is in the hands of professionals.
Why should a Policyholder’s Expert be appointed as soon as possible?
The second, and most important, is that the decisions made immediately after a claim occurs determine the strategy to be followed in the claim and can significantly influence the final outcome.
Managing the information from the very start of the appraisal process is essential to establish a solid approach.
How does appointing a Policyholder’s Expert affect the Insurance Company?
It does not affect them in any way.
In some cases, there is an unfounded fear that the Insurance Company may not agree with the Policyholder appointing their own Expert.
The Insurance Contract Law itself establishes the possibility and the right of every Policyholder to appoint their own Expert.
Moreover, many Experts actually welcome the presence of a Policyholder’s Expert, as it helps reduce their workload during the appraisal process.
What is the cost of appointing an Expert for the Policyholder’s defense?
The fees charged depend on the type of claim, the damages caused, and the conditions specified in the insurance policy.
Fees are always calculated as a percentage of the compensation obtained.
In the case of corporate policies and, in some instances, small and medium-sized businesses, these fees are covered by the policy itself, which allocates a percentage or a fixed amount for this type of intervention.
